Rental Equipment and Service Agreement

This agreement is between KusNea Event Rentals (Lessor) and the undersigned referred to as Lessee/Client/Customer. The Lessee/Client/Customer agrees to rent equipment(s) under rental terms and service agreement. Please read the entire rental agreement.

Deposit & Payment Policy: 
A 50% deposit is required to secure the rental(s) at the time of order unless this agreement is signed less than 14 days prior to the event which in this case the full rental balance is due upon signing this agreement. This deposit is non-refundable. The remaining balance is due 14 business days prior to delivery date unless Customer has established payment terms contract with KusNea Event Rentals .  All invoices MUST be paid in full prior to delivery or customer pickup. In addition, all sub-contractors required a 50% deposit which is non-refundable as well. There is no money back on all deposits.

We accept the following forms of payment: any major credit card, Wire transfer and Zelle. All card transaction requires a 3.5% processing fee, however, you may avoid these fees by making payment via Wire Transfer or Zelle. When sending Zelle please include the order # . In addition, the card is kept on file for damaged items, unreturned products, or additional charges. If overpayment is made, this will be credited back to the last form of payment once the delivery has been completed. Please allow 1-2 business days. Please note, there is absolutely no money back once payment is made.

Modifications
We understand the nature of event details changing last-minute. To help us best prepare your order, we kindly ask that no removal or date changes be made less than 2 days before the event date. Additional items may be added before delivery if item is available.

Deliveries & Pick-Ups: 
Delivery & Pick-Up charges is quoted as a round-trip fee. The delivery & pick-up charges is based on geographical location. Orders placed by individuals not connected to a venue, hotel, or job site must confirm drop off and pickup timing with their onsite event specialist.  Pick-up cutoff is 11:00PM EST, any time after is considered after-hours and there's an additional fee for after-hours pickup starting from $150. Any long distance is based on mileage and truck logistics. Delivery locations must be within 100 feet of the accessible truck or additional labor fees will apply. It is the responsibility of the client to inform KusNea Event Rentals of potential delivery obstacles, such as driveways not accessible by a truck, narrow doorways, stairs, or small elevators. KusNea Event Rentals will not be responsible if the equipment cannot be loaded onto a location due to obstacles.

To reduce these costs Customers are also welcome to pick up at our location. If picking up an order customer must have a van, truck or extra large SUV as most product do not fit in a standard car (such as non-foldable table and stack-up chairs). If you are not sure if your order will fit in your vehicle, please ask your  specialist for further dimension requirements. Please discuss with the sale representative if items will fit in your vehicle when ordering. Extended rental charges will be assessed if items are not returned on dates contracted as we have this inventory contracted for other events. Due to the current climate of global supply chain issues and inflation product variation, our pricing is subject to change without notice. We take every effort to ensure a product's quality and consistency throughout our product lines. However, due to model changes made by our manufacturers some products may vary slightly from what is listed in the catalog, price list, or website. We will make every effort to offer a substitute option should this occur unexpectedly. Should you have any issues before the event begins please contact our Sales Team and someone will assist you. Any missing or damaged items must be reported with photos before the event begins in order to best assist you. A credit will not be issued for any items that were unused or items turned away upon delivery.

All equipment must be returned to the place of delivery or additional labor fees will be applied. If rental equipment cannot be located on-site, additional pickup fees will apply to send a secondary crew out for retrieval. Please note that when multiple vendors are on-site it is the client’s responsibility to clearly break equipment out for recovery since items may be similar among vendors contracted of the job.

Setup: Setup, breakdown is available with advance scheduling. Labor fees are quoted based upon the scope of the project. If labor for setup and breakdown is scheduled, additional fee will be added to the invoice. We require a minimum of 1-2 hours window for setup and NOT less than 1 hour for pickup. Please note that the space must be ready upon arrival or additional fees will be charged for setup or breakdown. Floor plan must be provided at least 3 days prior to the delivery date to avoid additional labor charges and any changes not included on the floor plan and are made onsite will incur additional fees.

The driver will also ask that you sign the order form as proof of delivery. As a friendly reminder, an additional fee will apply for difficult access (stairs, No Freight Elevator, deep slope, difficult backyard access etc.). Our standard delivery is street level and dropping off to the 1st floor only, if items are requested to be delivered to a different area, an additional charge will occur. Also, if our drivers arrive to the event during the requested timeframe written on the contract and are asked to wait or unable to obtain KusNea Event Rentals property, client will be charge an additional $150+ inconvenience fee for a later pickup. Delivery does not include setup or breakdown; setup and breakdown services are available for an additional fee if an arrangement is made prior to delivery date.

All tables and chairs are delivered stacked and are to be picked up stacked and placed in one common area. Failure to follow this instruction will result in additional charges. All rentals’ Items MUST be secured and protected from harmful weather conditions including rain and wind. If rentals items are left out in the rain, returned, or picked up from customer premises wet or dirty (excessive grass, muddy water) the customer will be charge at $100+ cleaning fee and this amount can go up depending on the amount of rentals we have to clean. 

ELECTRIC POWER, LIGHTING AND WATER: Customer agrees to furnish KusNea Event Rentals with access to, and the right to use Customer's electrical power source and water line for the installation and operation of the rented equipment as needed.

UNDERGROUND UTILITIES: Customer agrees to have all Underground Utilities, in the vicinity of the equipment installation, clearly marked prior to the arrival of Kusnea Elegant Events And Rentals work crews.  It is the responsibility of the customer to communicate to KusNea Event Rentals of any underground wiring, pipes, sewage systems, or anything else that could interfere with the tent stakes. Stakes are driven between 1-3 feet under the ground. If any underground systems are not communicated toKusNea Event Rentals personnel or incorrect information is given, KusNea Event Rentals Kusnea will not be responsible for any underground damage. Customer assumes full responsibility for damage to all Underground Utilities. Please call 1-800-282-7411, Call Before You Dig Hotline 7 days before tent installation to schedule underground locating services.

Client Responsibilities: It is the responsibility of the client to check the contract to ensure that rented items is correct, address, time frame for delivery and pickup, date and contact information is correct. KusNea Event Rentals will NOT be responsible for incorrect information provided other than what is on the rental contract. It is also the responsibility of the client to check to make sure all rentals delivered is accounted for during the pickup time, and if anything is missing, the client will be involved and charge using the card on file without further notice. However, if the client finds the rental and return it we will issue a refund to the same card on file.

INSPECTION NOTICE:  All customers are responsible to inspect all rentals at the time of delivery, date and sign the invoice. In the case you are not there, please have someone available to inspect, sign and date the invoice.

SUBSTITUTION: KusNea Event Rentals carefully inspect all rental equipment to fill the order as requested. However, if circumstance prevent us from doing so, we will upgrade the quality or find a substitute product.

DAMAGE WAIVERS: 

The Damage Waiver covers rental items that have minor damage due to accidental breakage and wear and tear. The customer is responsible for any missing or major damages to equipment. The Damage Waiver fees are dependent upon products selected for 9% by the product line and are non-refundable.

Minor Damage is defined as normal expected wear and tear products on KusNea Event Rentals products.

• Accidental breakage
• Reasonable stains on furniture, chargers and accessories that is remedied when processing inventory back in.

Major Damages leaves us in a position where we are unable to fulfill orders for clients who have commit to our products includes:

• Neglect of equipment
  • Not using according to order instructions or manufacturer recommendations
  • Leaving rentals outdoors unprotected under the elements leaving items broken, wet, muddy, sandy.
  • Items return with excessive stained or torn
  • Burn holes or wax found on equipment
  • Unsecured items stolen from property
  • Product that has been damaged due to client or misuse (such as burn holes, stain, candle wax, mold, weather, rip/torn, move products from original location is considered major change and will result in a replacement charge.

All equipment must be re-packaged in the same condition as it was always received and protected from the weather. Broken equipment must be returned in order to for the damage Waiver to apply.

Note: Repair/Replacement will be assessed on any equipment due to loss, theft, misuse or abuse or intentional damage by client or client guests. Should any loss/theft or damage occur, client shall have the obligation to pay full-payment replacement cost and this will be billed 24-48 hrs of the event in addition to the rental charge. For customer pickup orders, if items are missing upon return we will assess replacement costs.

Charger plates must be scraped free of food and gum. Chairs cannot have stickers attached to it or gum stick underneath. Card on file will be charged for equipment replacement.

Liability: Client is responsible for the safety and reliability of the event venue and its furnishings. Customer is responsible in providing a one-day insurance if venue requires. Customer is also responsible for any injury, loss, death or damage from KusNea Event Rentals employee or equipment resulting from the conduct of event attendees and of staff not employed by KusNea Event Rentals . The client is also responsible for the rentals from the time of delivery until our company picks it up and shall pay for any rental damage or loss caused during that period. The damaged will be assed and the card on file will be charge.

Additional Terms of Lease:  KusNea Event Rentals is not responsible for bad weather, disruption of electrical service and/or unfavorable conditions that may arise, customer will receive full credit for the future order. For rescheduling, please give three weeks prior notice. 

CLEANING FEES: For rental return unclean, we charge a $150+ cleaning fees. Items like wax candle on candelabras we charge $50+ each for cleaning. We highly recommend using LED candlestick on our candelabras. In addition, No DARK jeans or clothing are to be worn, any stain will result in $200 plus cleaning fee or replacement cost of the item(s). Cleaning fee will be charge to the card on file if such thing is identified. In addition, for charger plates, in order to avoid being charged extra, please rinse charger before return.

Cancelation Notice: KusNea Event Rentals, like all other companies is concerned with the unprecedented global challenges that we are facing due to the coronavirus (COVID-19) and unforeseen conditions. If you should cancel or postpone your event due to weather conditions and/or unforeseen circumstances you may reschedule following this terms. Orders canceled the day before, day of, or at the time of delivery will incur a 100% cancellation fee since we are not able to rebook this product. Orders cancelled 60 days prior to the event date will forfeit a 35% deposit. For orders canceled 30 days prior to the event date, a 50% cancellation fee will occur. For orders canceled 48 hours prior to the delivery date, the day before, day of, or at the time of delivery will occur 100% cancellation fee. 
Cancellation fee schedule is as follow: 61 days or more, there is a 20-30% cancellation fee, 30-60 Days, there is 35% cancellation fee/ 48 hrs-30 days there is 50% cancellation fee. At the time of delivery and day of delivery and need to cancel there is 100% cancellation Fee. All payment paid made is non-refundable regardless of the reason. If you need to reschedule the event date we required at least 3 weeks in advance based on availability and this will still follow the cancellation fees guideline.

Rental Pick-Ups: Please do not move or relocate the rental without first informing us. Client shall have all equipment available for pickup byKusNea Event Rentals staff member(s) on the pick-up specified time. Additional fee will occur if we are unable to retrieve the rental equipment.

Returns: Rentals are due back based on the agreed upon return date and if not return will incur additional charge each day. Also, should in case the rental is returned broken/damage, customer will be charge at cost price.

Hold Harmless Provisions:   Lessee agrees to indemnify and hold KusNea Event Rentals  harmless from any and all claim, actions, suits, proceedings, costs, expenses, fees, damages and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising by reason of injury, damage, or death to persons or property, in connection with or resulting from the use of the leased equipment. This includes, but is not limited to , the manufacture, selection, delivery, possession, use, operation, or return of the equipment.  Lessee hereby releases and holds harmless KusNea Event Rentals from injuries or damages incurred as a result of the use of the leased equipment. KusNea Event Rentals cannot, under any circumstances, be held liable for injuries as a result of inappropriate use, God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless KusNea Event Rentals from any loss, damage, theft or destruction of the equipment during the term of the lease and any extensions thereof. 

Disclaimer of Warranties: KusNea Event Rentals makes no warranty of any kind, either express or implied, as to the condition of or performance of any leased equipment and Lessee agrees to immediately cease use of the equipment and contact KusNea Event Rentals if any of the lease equipment develops any indication defect or improper working conditions.  Lessee agrees to use the equipment at Lessees own risk.

Breach/Indemnity/Arbitration:  In the event that Lessee breaches any of the terms of this lease, that Lessee will pay for all consequential damages and further indemnify KusNea Event Rentals for all costs incurred by KusNea Event Rentals incurred in enforcing the terms of the lease or in defending any claim or lawsuit arising out of the operation of said equipment, including the amount of any judgment, attorney’s fees and costs.  If KusNea Event Rentals determines, within its own discretion, that Lessee has failed, in any way, to observe or comply with the conditions of this lease, KusNea Event Rentals may exercise any of the following remedies:  termination of this agreement; reenter property and retake the equipment; declare any outstanding rent and charges immediately due and payable and initiate whatever legal proceedings necessary to recover said equipment or monies; and/or pursue any additional remedies available it by law.  If a conflict arises, [company name] and Lessee will abide by the GA state laws and forgo filing a lawsuit to solve the dispute. 

BY SIGNING MY NAME ON THIS CONTRACT I, BEING THE LESSEE, CONTACT PERSON, LESSEE REPRESENTATIVE, OR OTHER INDIVIDUAL ASSUMING THE ROLE OF LESSEE, ACKNOWLEDGE THAT I HAVE COMPLETELY READ AND UNDERSTAND THIS CONTRACT AND ANY AND ALL ACCOMPANIED ADDENDUM(S). I HAVE BEEN FULLY INSTRUCTED BY KusNea Event Rentals PERSONNEL AS A TRAINED OPERATOR FOR THE AFOREMENTIONED EQUIPMENT AND HAVE HAD ALL OF MY QUESTIONS ANSWERED TO MY SATISFACTION.  I UNDERSTAND THAT  I AM SOLEY RESPONSIBLE FOR ADHERING TO THE TERMS SET FORTH BY THIS RENTAL CONTRACT AGREEMENT AND ANY AND ALL ACCOMPANIED ADDENDUM(S).
